The trial court held that a printout of an internal Merrill Lynch e-mail message was not admissible under Federal Rule of Evidence 803(6), where the government failed to produce sufficient evidence that Merrill Lynch required such records to be maintained, thus failing to satisfy the requirement that there be some evidence of a business duty to make and regularly maintain records of this type.
