Definition[]

U.S. trademark law[]

Under the Lanham Act, a service mark is

any word, symbol, name or device or any combination thereof used to identify the source of commercial services and to distinguish the services from those of another provider.[1]

A service mark is the same as a trademark except that it identifies and distinguishes the source of a service rather than goods. The terms "trademark" and "mark" are often used to refer to both trademarks and service marks.
