Overview[]
The Act, formerly referred to as the Individuals with Disabilities Act, expands FERPA protections. Regulations issued by the Department of Education to implement IDEIA provide for protection of personally identifiable information contained in educational records. For example, the IDEIA requires that the educational entity make reasonable efforts to obtain parental consent, and that consent must be obtained to conduct student evaluations to determine whether the child has a physical, mental or emotional disability.
