The Court determined that data brokers could be liable for the use of personal information that they obtain from state departments of motor vehicles and sell to others. The court held that the Driver's Privacy Protection Act of 1994 imposes a duty on resellers to exercise reasonable care in responding to requests for personal information drawn from motor vehicle records.
