Counterfeit drugs include

those sold under a product name without proper authorization — where the drug is mislabeled in a way to mimic an authentic product — as well as unauthorized generic versions of drugs approved by the Food and Drug Administration that mimic trademarked elements of such drugs. 21 U.S.C. §321(g)(2).[1]
