European Parliament, Directive 2010/13/EU of the European Parliament and of the Council of 10 March 2010 on the coordination of certain provisions laid down by law, regulation or administrative action in Member States concerning the provision of audiovisual media services (Audiovisual Media Services Directive (AVMSD)), Off. J. L. 95, 15.4.2010, at 1–24 (full-text).

Overview[]

The Directive provides for a single European TV market, where people can watch their favorite television programs from all over Europe, not just on TV, but also via the internet or on mobile phones. It amended and renamed the Television Without Frontiers Directive, providing less detailed but more flexible regulation.

This Directive sets forth a minimum set of common rule covering aspects like advertising and protection of minors. The Directive governs EU-wide coordination of national legislation on all audiovisual media, both traditional TV broadcasts and on-demand services.

This Directive entered into force on 19 December 2007 and had to be transposed by Member States by the end of 2009.

Gambling offers, where any audiovisual content is merely incidental to the service and not its principal purpose, are not considered AVMS.
