Factual Background Edit

The AP alleged that All Headline News (AHN) had, among other things, misappropriated the AP’s news stories when AHN located news stories on the Internet, paraphrased some, digested some, and reproduced others whole, and then posted such news under its own banner at its own website.

Trial Court Proceedings Edit

The court denied the motion to dismiss the hot news misappropriation claim, holding that the claim remained valid under New York law and was not preempted by federal copyright law.
